Getting your property back- an FAQ

Courtesy of Brooklyn Defender Services, here are the answers to some frequently asked questions about getting your property back from the police!

I am incarcerated at Rikers Island, how do I release property to someone outside who can pick it up?

  1. Visit the Constituent Services Office at your facility, and request the internal property release form. Complete this form, either releasing the property via the mail or to an individual who will pick up the property. The form takes 3-4 days to process.
  2. Once the form is processed, the person picking up the property must:
    1. Have the prisoner’s Book and Case, Property Voucher, and NYSID numbers on hand.
    2. Call 311 to schedule an appointment to pick up property.
    3. Make sure you get a Confirmation Number for your appointment.
    4. Once you have made an appointment, call one of the numbers below on the first day of your appointment with your confirmation number on hand to make sure that the property has been brought from the facility to the Central Cashier’s Office for pick up.

    5. During your appointment, go to the Central Cashier’s Office near family visiting with your Appointment Confirmation Number, the prisoner’s Book and Case and NYSID numbers, and a state-issued ID on one of the days during your appointment to retrieve the property.

I am incarcerated at Rikers Island, how do I release my property via the mail?

  1. In order to send property through the mail, you must have money on your books to pay for postage.
  2. Visit the Constituent Services Office at your facility and request the internal property release form for releasing property through the mail.
  3. The form may take some time to process, and it may take some time for the property to be boxed up and released. Keep an eye on your funds – once the deduction for postage has been made, your property should be sent through the mail.
  4. If you do not see any deduction for postage and your property has not been received by your contacts outside, follow up with Constituent Services, and if necessary, file a grievance requesting an update.

I have been released from Riker’s Island, how do I pick up my property?

  1. Have your Book and Case, Property Voucher, and NYSID numbers on hand.
  2. Call 311 to schedule an appointment to pick up property.
  3. Make sure you get a Confirmation Number for your appointment.
  4. Once you have made an appointment, call one of the numbers below on the first day of your appointment with your confirmation number on hand to confirm that the property has been brought from the facility to the Central Cashier’s Office for pick up.

  5. During your appointment, go to the Central Cashier’s Office near family visiting with your Appointment Confirmation Number, Book and Case number, a state-issued ID (if you have one), and your Property Voucher on one of the days during your appointment to retrieve your property.

I have been released from Rikers (to the outside or transferred to ICE or Federal Custody) how can I have my family or someone else pick up my property?

  1. You must complete the attached Department of Corrections Property Release in the presence of a notary.
  2. The person authorized to retrieve your property should then follow the steps below:
    1. Have the prisoner’s Book and Case, Property Voucher, and NYSID numbers on hand.
    2. Call 311 to schedule an appointment to pick up property.
    3. Make sure you get a Confirmation Number for your appointment.
    4. Once you have made an appointment, call one of the numbers below on the first day of your appointment with your confirmation number on hand to make sure that the property has been brought from the facility to the Central Cashier’s Office for pick up.

Some or all of my property is missing, what should I do?

  1. Have your Book and Case, NYSID and Property Voucher numbers on hand.
  2. Call the Rikers property room at the numbers below and ask if they have the missing property or a record of where the property may be.

If you are unable to locate the property through any of these channels, call 311 and file a complaint about the lost property – ask for details about how to be reimbursed for the missing property. If you need to have IDs or Immigration Documents replaced, contact your attorney and we will try to assist you during this process.

NYPD has my property, how can I or my family pick it up?

  1. Call the property clerk in your borough to confirm they have the property before going to retrieve it. If you are picking up property, be sure to have your Book and Case, NYSID, Property Voucher, and a state-issued ID on hand.

  2. If you are releasing property to someone else, complete the attached NYPD Property Release in the presence of a notary. The person picking up the property should call the NYPD property clerk at one of the numbers above to confirm they have the property. Be sure to bring a state issued ID, Book and Case, NYSID, Property Voucher, and the notarized NYPD Release when picking up property.

ICE has my property, what should I do?

  • Have your Alien Registration Number (A-Number) on hand and you or your family can contact ICE at the information below. Request to speak with the deportation officer handling your case. Ask the Deportation Officer to explain how you or someone else can pick up your property.
